Vehicle Protection Product
The Vehicle Protection Product Warranty must state:
"The obligations of the warrantor to the warranty holder are guaranteed under a warranty reimbursement insurance policy" or
"The obligations of the warrantor under this warranty are backed by the full faith and credit of the warrantor."
In the event a warranty holder must make a claim against a party other than the warranty reimbursement insurance policy issuer, the warranty holder is entitled to make a direct claim against the insurer upon the failure of the warrantor to pay any claim or meet any obligation under the terms of the warranty within sixty days after proof of loss has been filed with the warrantor, if the warrantor elects to meet its financial responsibility obligations under R.S. 32:1275(1).
The name and address of the issuer of the warranty reimbursement insurance policy. This information need not be preprinted on the warranty form, but may be added to or stamped on the warranty, if the warrantor elects to meet its financial responsibility obligations under R.S. 32:1275(1).
Identification of the warrantor, the seller, and the warranty holder.
The total purchase price and the terms under which it is to be paid. The purchase price is not required to be preprinted on the vehicle protection product warranty and may be negotiated with the consumer at the time of sale.
The procedure for making a claim, including a telephone number.
The payments or performance to be provided under the warranty including payments for incidental costs, the manner of calculation or determination of payments or performance, and any limitations, exceptions or exclusions.
All of the obligations and duties of the warranty holder such as the duty to protect against any further damage to the vehicle, the obligation to notify the warrantor in advance of any repair, or other similar requirements, if any.
Any terms, restrictions, or conditions governing transferability and cancellation of the warranty, if any.
"This agreement is a product warranty and is not insurance."
Louisiana Redhibition Warranty Disclaimers:
THE PRODUCTS BEING SOLD ARE IN AN "AS IS" CONDITION, without any warranties of any kind whatsoever. Purchaser expressly waives the warranty of fitness and the warranty against redhibitory vices and defects, whether apparent or latent, imposed by Louisiana Civil Code Articles 2520 through 2548, inclusive, and any other applicable state or federal law and the jurisprudence thereunder.
-Purchaser also waives any rights Purchaser may have in redhibition to a return of the purchase price or to a reduction of the purchase price paid pursuant to Louisiana Civil Code Articles 2520 to 2548, inclusive, in connection with the products hereby conveyed to Purchaser by Seller. Purchaser expressly acknowledges all such waivers and Purchaser's exercise of Purchaser's right to waive warranty pursuant to Louisiana Civil Code Articles 2520 through 2548, inclusive.
-Purchaser acknowledges and declares that neither the Seller nor any party, whomsoever, acting or purporting to act in any capacity whatsoever on behalf of the Seller has made any direct, indirect, explicit or implicit statement, representation or declaration, whether by written or oral statement or otherwise, and upon which the Purchaser has relied, concerning the existence or non-existence of any quality, characteristic or condition of the products sold.
-THE AFOREMENTIONED WARRANTY DISCLAIMERS DO NOT, IN ANY WAY, LIMIT OR OTHERWISE AFFECT THE TERMS OF ANY APPLICABLE WARRANTIES FROM THE MANUFACTURER OF THE TIRES/PARTS.
